The United States Environmental Protection Agency’s (EPA) classification of Perfluorooctanesulfonic Acid (PFOS) and Perfluorooctanoic Acid (PFOA) as hazardous substances is a significant shift in the environmental due diligence world. The designation of PFOS and PFOA compounds as hazardous substances reinforces the need for more robust environmental assessments as part of real estate transactions to identify any potential liabilities and to mitigate the risks associated with PFOS/PFOA contamination in soil and groundwater.
