
Hindsight in 2020: I Can See More EPA Regulations on the Horizon

December 2019 was a busy month for environmental regulatory changes. On December 20, 2019, the National Defense Authorization Act (NDAA) for 2020 was signed, which added certain per- and polyfluoroalkyl substances (PFAS) to the list of chemicals subject to annual Toxic Release Inventory (Form R) reporting. The focus of PFAS exposure includes industrial facilities that manufacture, process, or otherwise use PFAS. On December 9, 2019, the EPA also published the final rule for the addition of aerosol cans to the list of universal wastes. This rule will become effective on February 7, 2020. Under the new rule, intact aerosol cans may be disposed of as universal waste as regulations become streamlined.
