
A New Phase I ESA Standard: What Has Changed and How Does it Affect My Environmental Due Diligence?

It seems like just yesterday we were discussing updates to the 2013 Phase I Environmental Site Assessments (ESA) standard and yet here we are again with another revision to the standard that was recently approved by the EPA with an effective date of February 13, 2023. Why another revision? According to the ASTM bylaws, every eight years ASTM standards must be revised, re-approved as-is, or abandoned. This allows for an opportunity to improve the standard, make clarifications, update the standard to meet ever-changing environmental regulations, and address potential issues with the standard that have been identified since it was put into practice. During the revision process, the ASTM E1527 Task Group meets regularly for more than two years reviewing the text of the current Phase I ESA standard, establishing focus groups, and proposing changes and clarifications.
