In 2015, the U.S. Environmental Protection Agency (EPA) issued an update to the 1998 U.S. EPA policy on Supplemental Environmental Projects (SEP), which outlines guidance on how and when SEPs can be considered and included in civil settlements. Before settling an enforcement action all parties should carefully consider the major aspects of a SEP and whether undertaking a SEP resolves the underlying non-compliance issues, which the EPA considers to be a priority when approving a SEP. This webinar will discuss implementing an Environmental Management System as part of the SEP process.
